Terms and conditions

Last updated: 19 October 2026

This is a translation of the German AGB. The German version prevails.

1. Scope and provider

(1) These terms apply to all contracts for the use of AdLupe (adlupe.com) between Christian Schmitt, Performance Web Development, Konsul-Smidt-Straße 8C, 28217 Bremen, Germany ("we") and our customers.

(2) AdLupe is offered exclusively to businesses within the meaning of Section 14 of the German Civil Code (BGB), meaning natural or legal persons and partnerships with legal capacity acting in the course of their trade, business or profession. Consumers cannot enter into a contract. By signing in, you confirm that you use AdLupe as a business.

(3) The customer's own terms do not apply, even if we do not expressly object to them.

2. Account and conclusion of contract

(1) Your first sign-in with a passkey or an email code creates a user account. You then create a company, your team's shared workspace in AdLupe. The contracting party is the business you act for. Whoever creates a company or takes out a subscription confirms that they are authorised to do so.

(2) The subscription contract is concluded when you start the subscription in the dashboard, complete checkout with our payment provider Stripe and we activate access.

(3) Owners and admins can invite team members. The customer makes sure its team members comply with these terms and protects access (passkeys, mailboxes) from unauthorised use.

3. Services

(1) AdLupe analyses publicly accessible ad libraries. Today that is the Google Ads Transparency Center, accessed through the data service DataForSEO. Meta's Ad Library will follow once Meta grants access. For TikTok and LinkedIn, AdLupe links to the respective library.

(2) AdLupe usually fetches the ads of the competitors you track once a day, shows new and stopped ads in the dashboard and provides its analysis to AI assistants such as Claude and ChatGPT through an MCP interface. Each company includes up to 10 competitors, 5 keywords for industry monitoring and 3 markets. Otherwise the service description on adlupe.com at the time the contract is concluded applies.

(3) The data comes from third parties. We have no influence on which ads the platforms publish or whether they are complete, current and correct, and we give no warranty for this. If platforms change or discontinue their libraries or interfaces, individual sources may become unavailable temporarily or permanently.

(4) We do not owe any particular level of availability. Maintenance and disruptions at third parties, such as hosting, data sources or the provider of an AI assistant, may temporarily restrict use.

(5) To connect an AI assistant, the customer needs its own account with the respective provider, such as Anthropic or OpenAI. We are not responsible for their services or for the assistants' answers. AdLupe is not an official partner of these providers.

(6) We may develop AdLupe further and change features, provided the core of the service is preserved and the change is reasonable for the customer.

4. Prices and payment

(1) AdLupe costs €9.99 a month per company. All prices include statutory VAT.

(2) We bill monthly in advance through Stripe. The first payment is due when you take out the subscription, each further payment at the start of the next billing period. You receive invoices electronically.

(3) If a payment fails, Stripe will retry it. If payment is still not made, we may suspend access until it is received.

(4) We announce price changes by email at least 30 days in advance. They apply from the next billing period. The customer can cancel before then.

5. Term and cancellation

(1) The subscription runs for one month at a time and renews automatically for a further month.

(2) The customer can cancel at any time with effect from the end of the current billing period, in the dashboard under "Subscription" or in text form, for example by email to info@christianschmitt.dev. Access continues until then. We do not refund amounts already paid on a pro rata basis.

(3) We can cancel with one month's notice to the end of a billing period.

(4) Both parties' right to terminate for good cause remains unaffected. Good cause for us exists in particular if the customer breaches section 6 despite a warning.

(5) When the contract ends, access to the dashboard and the MCP interface ends. We delete account and company data on request, unless a retention obligation applies.

6. Rights of use and customer obligations

(1) For the term of the contract, we grant the customer a non-exclusive, non-transferable right to use AdLupe and its analyses for its own business purposes, including through its team members.

(2) In particular, the customer may not:

  • resell, rent out, sublicense or publish raw data from AdLupe, meaning lists of ads, ad copy, images, videos and exports, in whole or in substantial part,
  • read AdLupe automatically beyond the interfaces provided, or overload the interfaces,
  • share access with people outside its own business,
  • circumvent security measures.

(3) The rights to the ads belong to the advertisers and other rights holders. AdLupe shows the ads for analysis. If the customer uses ads beyond that, for example in publications, it is responsible for complying with copyright, trade mark and competition law.

(4) If the customer breaches these obligations, we may suspend access until the breach has been remedied.

7. Liability

(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee.

(2) For slightly negligent breach of an essential contractual obligation, our liability is limited to the foreseeable damage typical for this type of contract. Essential obligations are those whose fulfilment makes performance of the contract possible in the first place and on whose observance the customer may regularly rely.

(3) Otherwise, liability for slight negligence is excluded. Strict liability for defects that already existed when the contract was concluded (Section 536a(1) BGB) is excluded.

(4) These limitations also apply in favour of our vicarious agents (Erfüllungsgehilfen).

8. Data protection

Our privacy policy explains how we process personal data.

9. Changes to these terms

(1) We may change these terms with effect for the future if there is a valid reason, such as a change in the law, new features or a change to a data source.

(2) We announce changes by email at least 30 days before they take effect. If the customer does not object by then, they are deemed accepted. We point out this consequence in the announcement. If the customer objects, either party may cancel with effect from the date the changes take effect.

10. Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, or has no general place of jurisdiction in Germany, the exclusive place of jurisdiction for all disputes arising from the contract is Bremen.

(3) If any provision of these terms is invalid, the rest of the contract remains valid. The statutory provisions then apply.

(4) These terms are available in German and English. The German version prevails.
